Medicare Part D Creditable Coverage Notice Reminder

Due before October 15, 2025

As part of the Medicare Prescription Drug Improvement and Modernization Act (MMA) employers who offer prescription drug coverage must provide a notice to all Medicare-eligible employees and dependents each year. This notice informs individuals whether their prescription drug coverage is considered “creditable” (equal to or better than Medicare’s standard plan) or “non-creditable”.

What to know:

  • Notices must be distributed prior to the Medicare Annual Election Period which begins on October 15 each year.
  • Notices must be sent to all Medicare-eligible plan participants and dependents, not just those enrolled in the employer’s plan.
  • Employers must also disclose their plan’s status to CMS by completing the online CMS Disclosure Form. This must be submitted:
    • Within 60 days of the start of each plan year,
    • Within 30 days after termination of a prescription drug plan, and
    • Within 30 days after any change in creditable coverage status.

Delivery Options: Notices may be delivered by mail or electronically. Electronic delivery is permitted if employees have regular work-related computer access or if other recipients provide written consent. Employers must also notify recipients that they are responsible for sharing the notice with any Medicare-eligible dependents.
